Terms & Conditions

These terms govern every sale made through this website. They are written to be readable, and they work alongside your rights under the South African Consumer Protection Act and Electronic Communications and Transactions Act. Please read them before you order.

1. About us

This website is owned and operated by AAK Holdings, a private company registered in the Republic of South Africa (2018/463291/07), VAT number 4890273651, with its principal place of business at 19490 Boitekong Ext 8, Rustenburg, North West, 0308, South Africa. In these terms, “we”, “us” and “AAK Holdings” refer to that company, and “you” means the customer.

2. Agreement

By browsing this website, adding items to a cart or placing an order, you agree to these terms, our Return & Refund Policy, Shipping & Delivery Policy, Payment & Security Policy and Privacy Policy, which form part of the agreement. If you order on behalf of a company, you confirm that you are authorised to bind that company.

3. Product descriptions

We aim to describe every container accurately, including condition, dimensions and included fit-out. Images are representative; because containers are industrial goods, paint shade, minor dents, surface rust and decals may vary between units. Used containers are sold as inspected by our yard team and graded as described on the product page. Specifications are supplied in good faith, but should be verified before engineering, construction or installation work.

4. Pricing and VAT

All prices are in South African rand and include 15% VAT unless expressly stated otherwise. A VAT invoice is issued for every sale. Prices exclude crane hire, permits, engineering certificates, site preparation, plumbing or electrical connections beyond what is listed, and any delivery surcharge for outlying areas, these are quoted separately and disclosed before payment. We may correct pricing or specification errors before dispatch; if a corrected price is higher than you paid, you may cancel for a full refund.

5. Orders and acceptance

  • Placing an order constitutes an offer to purchase the goods at the stated price.
  • Our acceptance occurs when we confirm the order in writing and receive cleared payment (or an approved credit arrangement).
  • We may decline or cancel an order where stock is unavailable, the price was listed in error, payment cannot be verified, the order appears fraudulent, or delivery cannot reasonably be performed.
  • Stock is reserved for 48 hours pending payment unless agreed otherwise in writing.

6. Payment

We accept card, instant EFT and bank transfer through our South African payment partners. Custom conversions require a 60% deposit with the balance due before dispatch. Where payment is made by EFT, goods are released once funds reflect in our account. We do not accept cash on delivery for containers. Risk of fraud: never pay into an account not issued on a AAK Holdings invoice; verify banking details by phoning us before paying.

7. Delivery, collection and risk

Delivery timeframes are estimates given in good faith and calculated in working days. Risk passes on delivery or collection; ownership passes only on receipt of full payment. You must provide safe, lawful site access and confirm that the placement point is suitable and legally permitted. Additional charges may apply for failed deliveries, waiting time or abortive crane hire caused by unsuitable access. Full details are in our Shipping & Delivery Policy.

8. Returns, refunds and warranty

Returns, refunds and warranty claims are governed by our Return & Refund Policy, which forms part of these terms. Change-of-mind returns on stock containers are accepted within 14 days, subject to a 15% handling and transport fee and condition requirements. Faulty goods are always handled in line with the Consumer Protection Act and at our cost.

9. Permits, approvals and your obligations

You are responsible for obtaining any municipal, estate, body corporate or landlord approvals required to place a container on your property, and for complying with zoning, building, occupational health and safety and environmental rules. You are also responsible for preparing a suitable foundation or hardstand, and for maintaining the container (including gaskets, paint and ventilation) after delivery.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, special or consequential loss, loss of profit, loss of business opportunity, or damage arising from delay, incorrect site preparation, overloading, unauthorised modification or failure to maintain the goods. Our total liability for any claim relating to a product is limited to the price paid for that product. Nothing in these terms excludes liability for gross negligence, wilful misconduct, fraud or death and personal injury caused by our negligence, and nothing limits your non-excludable rights under South African consumer law.

11. Intellectual property

All content on this website, including text, images, product photography, logos and layout, is owned by us or licensed to us and may not be copied, reproduced or used commercially without written permission. “AAK Holdings” and our visual identity are our trade marks.

12. Force majeure

We are not in breach of these terms for delays or failures caused by events beyond our reasonable control, including severe weather, floods, fires, road closures, civil unrest, labour action, load-shedding, port congestion, supplier failure or government restriction. We will notify you promptly and agree a revised plan or a fair cancellation.

13. Privacy and data

We process personal information as described in our Privacy Policy, in compliance with POPIA. We never sell your data.

14. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrate's Court having jurisdiction over the purchaser, without affecting our right to institute proceedings in a High Court where appropriate. Before litigation, both parties agree to attempt to resolve the dispute in good faith for 20 business days. Consumer complaints may also be referred to the National Consumer Commission.
